Terms of service

BIDWAY.si terms of service
Version: 12 October 2026.

1. Provider and scope

The provider is BIDWAY spółka z ograniczoną odpowiedzialnością, ul. Świeradowska 47, 02-662 Warszawa, Polska; KRS 0001264414, NIP 5214178927. Contract, complaint and cancellation contact: kontakt@bidway.eu. BIDWAY.si serves businesses and their representatives. Mandatory consumer and equivalent statutory protections remain intact.

Public registration and sales are closed during the current test phase. Stripe tests are not actual payments. The paid subscription below applies only after sales open and a purchase is confirmed.

2. Service

The platform provides a company profile, matching against available notices, AI document analysis, checklists, PDF reports and drafts based on source forms. Automatic collection covers Slovenian TED notices. The complete national PJN/e-JN database is not automatically included; users can upload documents. A TED notice analysis does not replace full procurement documentation.

Supported accessible documents are processed within upload limits of 20 files, 8 MB each and 32 MB total. Missing or unreadable material limits the result. Drawings and extensive technical attachments may be flagged for separate review; the inventory identifies what was read. Freshness checks cannot guarantee that no subsequent change exists.

AI can misinterpret a correctly quoted source. Users check originals, later clarifications, eligibility, prices, deadlines and signatures. BIDWAY does not guarantee an award, represent a bidder, sign or submit bids. ESPD must use the required original/official eESPD form. The platform cannot issue FURS or criminal-record certificates, bank guarantees, references or certifications. Reports and drafts are in Slovenian even with the English interface.

3. Account

You need internet, a current browser with JavaScript and necessary cookies, working email and suitable software for DOCX/XLSX downloads. When registration opens, accept the terms and set a password through email. Account creation does not start a paid subscription. Protect credentials and links, use authorised accounts and accurate information. Request deletion from support.

4. Price and allowances

The planned total price is EUR 67.99 monthly, including 10 analyses and 10 document preparations per period. The provider must verify business-customer tax treatment and billing arrangements before sales open; no price increase is applied without clear disclosure before order confirmation. BIDWAY adds no card-payment fee.

A new analysis or preparation reserves one corresponding allowance. Failed jobs return it. Downloading a finished result again does not use another allowance; a new job after changes does. Unused allowances do not roll over. The panel shows the period and remaining allowances.

5. Payment and renewal

Payment will be by card through Stripe as a monthly subscription renewing until cancelled. Price, scope and payment obligation are shown before confirmation. The paid contract is formed after successful payment and access follows verified Stripe confirmation. Returning from checkout alone is not proof of payment; contact support before repeating a delayed purchase.

Cancel renewal in the subscription portal or by email before the next renewal. Cancellation does not shorten a paid period. Logging out does not cancel. Contact support for an accounting document if it is not available through the payment portal.

6. Withdrawal and complaints

Where a statutory withdrawal right applies, you may withdraw within 14 days without reason by a clear statement to our contact address. Example: “I withdraw from the BIDWAY contract of …; name, account email, date.” Sign paper statements. This template is optional and timely dispatch is sufficient.

Starting performance before the withdrawal period expires requires an appropriate express request. A proportionate charge for work performed is only possible where statutory conditions are met. An account or one analysis does not automatically remove all rights. Refunds where due normally use the original method without extra fees within the applicable statutory period, no later than 14 days from withdrawal notification where that period applies.

Complaints should identify the account email, problem, date and job/payment ID. Do not send passwords or card details. We respond within 14 days, subject to more favourable mandatory rules. Statutory digital-service conformity liability remains applicable. An unused business allowance alone does not automatically entitle the buyer to a refund.

7. Safe use and availability

Unlawful content, rights infringement, access to others' data, limit circumvention and overload are prohibited. You must be entitled to upload materials and omit unnecessary sensitive data. Serious security risks may require limited access restrictions, with reasons where safe and lawful; other breaches normally receive a request to remedy first.

Maintenance, provider failures and public-source changes may interrupt service. We notify significant planned maintenance where possible and assess complaints and billing against actual undelivered service. Mandatory liability is not excluded.

8. Processing for a business

Where the customer is controller of data in uploaded documents, BIDWAY processes it on documented instructions for account operation, analysis, preparation and result storage during the contract. The scope is necessary ordinary identification, business contact, roles, experience and qualifications of representatives, staff and participants, excluding special-category and criminal-conviction data.

BIDWAY ensures confidentiality, risk-appropriate security, assistance with rights and GDPR Articles 32–36, breach notification without undue delay, compliance information and reasonably arranged review under Article 28. It reports unlawful instructions. The customer generally authorises necessary subprocessors Hetzner, Resend and OpenAI; changes are notified at least 14 days ahead with a reasonable objection opportunity. If no suitable alternative exists, the parties arrange termination and settlement of the affected service. Transfers must comply with GDPR Chapter V.

On termination, data is returned or deleted at the customer's choice, including backups through their retention cycle, except legally required retention. BIDWAY acts as controller for its own accounting and security purposes as described in the privacy policy.

9. Changes and law

Material terms or future-period price changes are notified at least 14 days before application unless mandatory law provides otherwise. Paid periods are not changed retrospectively and users can cancel future renewal. Polish law applies without removing mandatory user protections, including applicable Slovenian consumer rights. Jurisdiction follows applicable law. Save or print these terms. See the privacy policy for data information.

WordPress login cookies normally last 2 days, or 14 days with “Remember me”. bw_cookie_notice remembers dismissal for 180 days and contains no account identifier.

The admin interface may store additional preferences. You can delete cookies in your browser; blocking necessary cookies may prevent login. The Stripe payment portal has its own information and settings.
